NYC TVB ticket conviction – Appeal

Were you found guilty by a judge for a New York City traffic ticket? If you have, like most people you are probably wondering what can be done about it.

Does it matter?

Being convicted of a traffic ticket in NYC can be serious.  Depending on the violation, a motorist can wind up paying dearly for the ticket. For example, it can mean paying thousands of dollars in car insurance increases and New York State Driver Responsibility Assessment. It is important, though, to understand the process of the courts in the five New York City boroughs: Bronx, Brooklyn, Manhattan, Queens and Staten Island.

The Courts

Courts in the five boroughs are run by DMV TVB – an Administrative Agency and not the city. This matters because the court set and follow their own rules. The biggest difference between a NYC DMV TVB and other courts is that there is no “plea bargaining” or negotiating. Points are not lowered or eliminated. Instead each case is an “all or nothing.”

Every ticket goes to trial and at the end of the trial, a judge will decide whether or not the driver is guilty or not guilty of the violation. Upon a guilty finding, points will be added to the motorist driving abstract. Other negative consequences may also accrue, like a DMV assessment fee.

 What now?

Being convicted does not mean there are no options. A motorist can appeal the guilty verdict. The appeal is time sensitive and must be submitted within 30 days of the date of conviction. There is a small fee to file the appeal and the appeal can be submitted online or by mail.

Filing an appeal does not mean the court will grant it. Since you have one shot at an appeal, it is worth enlisting the help of a qualified and reputable traffic attorney to will ensure your case is handled correctly from start to finish. This will put you in the best position for a favorable outcome.
